Over the last two years, the most talked about topic in e-Discovery has been predictive coding and other technology assisted review tools. Despite the buzz, many litigants have not yet embraced these technologies or deployed the tools in their discovery efforts. But soon there may be no choice – we are seeing a significant trend towards requesting parties, regulatory agencies, and courts insisting that producing parties use predictive coding to comply with document discovery obligations.
